Compliance for Trust
A Public Charitable Trust is governed by the Indian Trusts Act, 1882 or relevant State Trust laws and is commonly formed for charitable, religious, educational, or social welfare purposes. Unlike companies, trusts have relatively simpler governance structure, but they still require strict financial and legal compliance to maintain tax exemptions and legal validity.
Trust compliance primarily revolves around proper maintenance of accounts, timely filing of income tax returns, adherence to conditions under Section 12AB and 80G (if registered), and ensuring that funds are utilized strictly for charitable purposes as defined in the Trust Deed. Trustees have a fiduciary duty to manage the trust assets responsibly and in accordance with the objectives of the trust.
In addition to income tax compliance, trusts may also be required to comply with FCRA regulations if they receive foreign contributions, GST compliance if applicable, and local registration requirements depending on the state law.
Key Compliances
Trusts must maintain books of accounts, prepare annual financial statements, file Income Tax Returns, comply with audit requirements where applicable, and maintain records of donations and expenditures. Any amendment in trustees, address, or objectives must be updated with relevant authorities.
Income Tax Compliance
Filing of ITR-7 is mandatory for charitable trusts. If registered under 12AB or 80G, conditions relating to application of income, accumulation of funds, and audit requirements must be strictly followed.
Audit Requirements
Audit is mandatory if income exceeds the basic exemption limit under Income Tax Act or if required under trust deed or applicable registration conditions.
