FCRA Prior Permission

FCRA Prior Permission is a one-time approval granted by the Ministry of Home Affairs (MHA), Government of India, allowing an eligible organization to receive a specific foreign contribution from a specific foreign donor for a specific project or purpose. It is primarily intended for newly established NGOs or organizations that are not yet eligible for regular FCRA Registration but have secured foreign funding for a defined charitable activity.

Unlike regular FCRA Registration, which permits an eligible organization to receive foreign contributions on an ongoing basis, Prior Permission is project-specific and donor-specific. Once the approved contribution has been received and utilized in accordance with the approved project, any future foreign contribution generally requires either another prior permission or regular FCRA Registration, depending on eligibility.

This mechanism enables new organizations to lawfully access foreign funding while ensuring that foreign contributions remain transparent and are utilized only for approved charitable purposes.

Legal Framework

FCRA Prior Permission is governed by:

  • Foreign Contribution (Regulation) Act, 2010
  • Foreign Contribution (Regulation) Rules, 2011 (as amended)
  • Notifications and circulars issued by the Ministry of Home Affairs (MHA)

Eligibility

An organization may generally apply for FCRA Prior Permission if:

  • It is registered as a Trust, Society, or Section 8 Company.
  • It is not eligible for regular FCRA Registration, such as a newly established organization.
  • It has identified a specific foreign donor.
  • It has a clearly defined project for which foreign funds are required.
  • It receives a written commitment from the foreign donor specifying the amount and purpose of the contribution.
  • It fulfills the other statutory conditions prescribed under the FCRA.

When is Prior Permission Required?

FCRA Prior Permission is commonly sought when:

  • A newly registered NGO receives its first foreign donation.
  • A foreign organization agrees to fund a specific charitable project.
  • The organization is less than three years old and therefore not yet eligible for regular FCRA Registration.
  • Foreign funding is required for a one-time project or activity.

Documents Required

Generally, the following documents are required:

  • Registration Certificate.
  • Trust Deed, MOA, or AOA.
  • PAN Card of the organization.
  • Commitment letter from the foreign donor specifying the amount and purpose.
  • Detailed project report.
  • Governing body details.
  • Identity documents of key functionaries.
  • Details of the designated FCRA bank account.
  • Affidavits and declarations, wherever applicable.

Registration Process

The organization’s legal status, proposed project, and donor commitment are examined.

Step 2 – Preparation of Documents

The project proposal, donor commitment letter, statutory documents, and declarations are prepared.

Step 3 – Filing of Application

The prescribed application for Prior Permission is filed electronically with the Ministry of Home Affairs along with the required documents and applicable fee.

Step 4 – Verification

Upon approval, the organization is permitted to receive the specified foreign contribution from the approved donor exclusively for the approved project. Recent government directions also prescribe validity periods for receiving and utilizing funds approved under prior permission.
