Multi-State Cooperative Society Registration

A Multi-State Cooperative Society (MSCS) is a cooperative organization with operations and members in more than one state in India.

Unlike single-state societies, MSCSs are registered under the Multi-State Co-operative Societies Act, 2002, and regulated by the Central Registrar of Cooperative Societies under the central Ministry of Cooperation.

The cooperative societies with objects confined to more than one state are governed by the central law, namely, ‘the Multi-State Co-operative Societies Act 2002 (Act 39 of 2002). The Central Registrar of Cooperative Societies is appointed as per article 243ZH(f) of the Constitution read with subsection (1) of section (4) of the Multi-State Cooperative Societies Act 2002 and is the statutory body responsible for registration and other processes of the Multi-State Cooperative Societies (MSCS).

Check list regarding documents to be submitted with the proposal for New Registration

  1. Form 1: To be submitted in the format annexed with the MSCS Act 2002 along with the documents required under Form I.
  2. A certificate from the bank stating the credit balance there in favor of the proposed multi-state co-operative society.
  3. A scheme explaining how the proposed multi-state cooperative society has reasonable prospects of becoming a viable unit.
  4. Four copies of the bylaws in original.
  5. The proposed area of operation for registration shall initially be permitted for two contiguous states only.
  6. List of at least 50 members from each state. The list has to be submitted in the format annexed with the MSCS Act 2002 along with the copies of ID proofs of the members duly attested by the chief promoter.
  7. Certified copies of the resolutions passed by the proposed society along with the certified copy of the resolution of the promoters, which shall specify the name and address of one of the applicant(s) to whom the Central Registrar may address correspondence under the rules before registration and dispatch or hand over registration documents.
  8. Contact number and e-mail address of the chief promoter or society on the cover page.

For societies having objects related to thrift and credit and for multi-purpose societies, the following additional documents are required to be submitted along with documents mentioned above:

  1. No objection certificate from the Registrar of Cooperative Societies of the States/U.T. where the area of operation of the society is proposed to be confined.
  2. A certificate to the effect that the credentials of the Chief Promoter/Promoters have been verified by the Registrar of Co-operative Societies of the state where the head office is proposed to be located.

Societies that are already registered under the MSCS Act, 2002, and are desirous of expanding their area of operations falling under category (B) above shall be required to submit an NOC as mentioned in Note No. 1 (1).

Amendment in Multi-State Cooperative Society

Amending the internal rules or bylaws of a multi-state cooperative society requires a general meeting resolution passed by a two-thirds majority of members present and voting, followed by formal registration with the Central Registrar of Cooperative Societies under the Multi-State Cooperative Societies Act.
