FCRA renewal

As per rule 12 of FCRR,2011, which deals with tha procedure for renewal of registration, an application in form FC-3C [as amended by the Foreign Contribution (Regulation) Amendment Rules, 2015] have to be filed before six months from the due date. As such the existing organization which has been granted registration under FCRA, 1976 had to apply for renewal in the prescribed form on or before 1st November 2015. However, the ministry of Home affairs has extended the due date of filing of renewal to 15th March 2016 in view of launch of their new website. The Notice relating to the extension of time is given in Annexure to this Chapter.

Earlier, in case of the organizations implementing ongoing multiyear projects, they could apply for renewal 12 months before the date of expiry of the certificate of registration. The Foreign Contribution (Regulation) Amendment Rules,2015 have omitted this rule 12 sub-rule (3). Consequently, they shall apply to the Central Government in form FC-6 six months before the expiry of the registration.

Rule 12 of FCRR, 2011[as amended by the Foreign Contribution9Regulation) Amendment Rules, 2015] is as under:

• 1) “Every certificate of registration issued to a person shall be liable to be renewed after the expiry of five years from the date of its issue on proper application.
• 2) Every person shall apply to the Central Government in Forms FC-3 , six months before the date of expiry of the certificate of registration, for its renewal.
• 3) A person implementing an ongoing multi-year project shall apply for renewal twelve months before the date of expiry of the certificate of registration.
• 4) An application made for renewal of the certificate of registration shall be accompanied by a fee of Rs 5000
• 5) The fee for renewal of the certificate of registration shall be remitted by demand draft or bankers cheque in favour of the “pay and Accounts officer, Ministry of Home Affairs’, payable at New Delhi or through online electronic payment gateway as specified by the central Government.’
